Terms of service

1. About these terms
These terms apply when you use 3decorstudio.com or buy anything from us. By using the site or placing an order, you agree to them. If you don't agree, please don't use the site.
3DecorStudio is operated by Marko Pavic, a sole trader based in Sydney, New South Wales. In these terms, "we", "us" and "our" mean 3DecorStudio, and "you" means you.

If anything in these terms conflicts with our Refunds and Returns policy, the Refunds and Returns policy wins.
2. Who can buy
You need to be at least 18 and able to enter a contract. If you're under 18, ask a parent or guardian to place the order.
We sell to customers in Australia only. We can't ship anywhere else at the moment.
3. What we sell
We make small 3D-printed planters in PLA. Each one is fitted with an artificial succulent and real pebbles, set in place with PVA glue, and assembled by hand in Sydney.
Because each item is made and finished by hand:
- there will be small variations between items in pebble placement and the exact set of the succulent
- fine layer lines are visible on printed surfaces — that is how 3D printing works, and our photos show it honestly
- colours on your screen may not exactly match the item, because screens differ
We describe our products as accurately as we can, and our photos are of the actual products. Nothing here reduces your right to receive goods that match their description — see our Refunds and Returns policy.
These are decorative objects. They are not live plants, they contain no soil, and they should not be used to hold water or a living plant.
They are not suitable for children under 3. They contain small parts, including pebbles that could come loose.
4. Availability
Everything is made in small batches, so stock is limited and things sell out. If we can't supply what you ordered, we will tell you and refund you in full. We may withdraw or change any product at any time before you order.
5. Prices, and GST
All prices are in Australian dollars (AUD).
We are not registered for GST. Our turnover is below the $75,000 threshold at which GST registration becomes compulsory. That means:
- no GST is included in our prices, and no GST is added at checkout
- the price shown on the product page is the full price of the item — shipping, if any, is shown separately at checkout
- we cannot issue a tax invoice, and we do not have an ABN to quote
You will get an order confirmation and receipt by email. That is your record of the purchase and is what we will accept as proof of purchase for any return or claim. It is not a tax invoice and does not show a GST component, because none was charged.
If you are buying for a business and your accounting process needs a tax invoice with an ABN, please buy elsewhere — we can't provide one.
Prices can change at any time, but a change never affects an order we have already accepted.
Pricing errors. If we list something at an obviously wrong price — a decimal in the wrong place, that sort of thing — we are not obliged to supply it at that price. If it happens, we will contact you before dispatch and you can either pay the correct price or cancel for a full refund. We will not just charge you more without asking.
6. Orders and acceptance
A product listed on our site is an invitation for you to make an offer, not an offer we're bound by.
Here's how an order actually works:
- You place an order and pay. You'll get an automatic email confirming we received it. That email is a receipt, not our acceptance.
- We check we can supply it.
- We accept your order when we dispatch it and send you a dispatch confirmation. That's when the contract is formed.
Before we dispatch, we can decline or cancel an order — for example, if the item is out of stock, if there was a pricing error, if we can't deliver to your address, or if we suspect fraud. If we cancel, you get a full refund, and we will tell you why.
7. Payment
We accept payment through Shopify Payments and PayPal. Payment is taken when you place the order.
Your card details go directly to the payment provider. We never see or store your full card number. Each provider has its own terms and privacy policy, which apply to your payment.
If a payment is reversed or charged back without a good reason, we may recover the amount from you.
8. Delivery and risk
Our Shipping Policy sets out where we ship, how long we take, what it costs and which services we use. Please read it — it forms part of these terms.
Delivery timeframes we quote are estimates. Once a parcel is with Australia Post, its progress is out of our hands.
Risk. Risk of loss or damage in transit stays with us until the parcel is delivered to the address you gave us. If your order is lost or damaged on the way, that's ours to fix — see the Refunds and Returns policy. You don't need to make a claim with Australia Post yourself.
Two exceptions, and they're the obvious ones:
- if you gave us an incorrect or incomplete address
- if you instructed the carrier to leave the parcel unattended (an "authority to leave" or safe-drop instruction), in which case risk passes when it's left as you asked
Title. Ownership of the goods passes to you when we've received payment in full.
9. Our website and our content
The text, photographs, layout, logo and name on this website are owned by us or used by us under licence. You may look at them, and share links to our pages. You may not copy, reproduce, republish or use them commercially without our written permission.
Buying a product gives you the product. It does not give you any right to copy the design, 3D scan it, take a mould from it, or reproduce it — whether for sale or otherwise.
10. Acceptable use
Please don't:
- use the site for anything unlawful, or to send anything unlawful, offensive or misleading
- use bots, scrapers or automated tools to harvest content, prices or images
- try to break, overload or get unauthorised access to the site or anyone's account
- introduce malware
- buy from us to resell our products commercially without our written agreement
- impersonate someone else, or use false details at checkout
We may refuse service, cancel orders or block access if you do any of this.
11. Reviews and anything else you send us
If you send us a photo or a review, you're confirming it's yours to share and it's honest. You give us permission to publish it on our site and social media, with your first name. Tell us if you'd rather we didn't and we won't. You can ask us to take it down at any time.
We may remove anything that's abusive, misleading, or not really about the product.
12. Site availability
We try to keep the site up and accurate, but we don't promise it will always be available, uninterrupted or error-free. We may change or take down parts of it at any time. Sometimes Shopify or a service we depend on goes down and that isn't something we control.
13. Liability
Read this first: nothing in these terms excludes, restricts or modifies any consumer guarantee, right, warranty or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. If any part of these terms would do that, that part simply doesn't apply.
Subject to that:
- We are not liable for indirect or consequential loss, or for loss of profit, revenue, data or opportunity, arising from your use of the site or our products, to the extent the law allows us to say so.
- Where the law permits us to limit our liability for goods (rather than exclude it), our liability is limited, at our option, to replacing the goods, supplying equivalent goods, or paying the cost of doing so.
- Except for liability we can't limit by law — which includes liability under the consumer guarantees, for death or personal injury, and for fraud — our total liability for any order is limited to the amount you paid for it.
- We aren't liable for things genuinely outside our control, including postal delays and disruptions, natural disasters, and failures of third-party platforms and payment providers.
You're responsible for using our products sensibly, including keeping them away from small children and away from heat.
14. Privacy
We handle your personal information as set out in our Privacy Policy.
15. Changes to these terms
We may update these terms. The version on this page at the time you place an order is the version that applies to that order. We won't change the terms of an order after you've placed it.
16. General
- If any part of these terms turns out to be unenforceable, the rest still applies.
- If we don't enforce something straight away, we haven't given up the right to enforce it later.
- You can't transfer your rights under these terms to someone else without asking us.
- These terms are the whole agreement between us about your order.
17. Governing law
These terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales.
If you live somewhere else, this does not take away any rights you have under the consumer laws of the place you live that cannot be excluded by agreement.
